More than 200 people filled the Column Hall at the Sejm of the Republic of Poland during the conference “Personal losses – doctrine, judicial rulings, insurance practice”. The conference, which was held on 27 November, was organised by: the Parliamentary Club of Polskie Stronnictwo Ludowe, National Council of Legal Advisers, and the Polish Insurance Association. This was one of the largest conferences organised by the PIU in recent years.

The aim of the event was to exchange views about personal losses and the related issue of compensation for the harm caused in a motor accident and the scope of claims to which persons close to a claimant are entitled in such cases. The conference was opened by Zbigniew Tur, Vice-president of the National Council of Legal Advisers. The guests were also greeted by J. Grzegorz Prądzyński, President of the PIU, who stated that predictability of recompense is a key issue. He added that this aspect is very important to claimants but also to insurance companies since it makes it possible to predict the premium in a reliable and realistic way.
Józef Zych, PhD – Judge of the State Tribunal and Sejm Speaker during the II session of the Sejm of 1993–1997, raised the issue of personal loss in court and insurance doctrine and practice. He stated that even in w 2012, jointly with Andrzej Maciążek, Vice-president of the PIU, he initiated efforts to have the Civil Code amended to better regulate the issue of recompense. Citing PIU data, he added that only 20% of claims for recompense end up in court, while 80% end with a settlement.

Andrzej Maciążek, Vice-president of the PIU, talked about insurance issues associated with claiming recompense, the costs of treatment and rehabilitation as part of compulsory third-party liability motor insurance, and voluntary third-party liability insurance for hospitals and physicians. He pointed out that every policy holder is an economic payer of recompense and it is in the interest of many entities to regulate them and to bring about predictability. This means that legislative changes in the legal system are needed urgently.

Doctor Dorota Gałczyńska Zych, director of the Fr. Jerzy Popiełuszko Memorial Bielany Hospital, talked about the hospital’s experiences in determining the costs of treatment and rehabilitation. She also emphasised the importance of post-accident rehabilitation of claimants and the implications it has for subsequent return to health and life.

The conference ended with a presentation given by Zbigniew Tur, who talked about the problems related to the law in connection with pursuing recompense in common courts and the role of the legal adviser. Moreover, he emphasised the need for legal advisers to cooperate with physicians in order to take a joint decision on the value of the claim. A publication of the Supreme Court called “Recompense for a claimant in a motor accident and for persons close to the claimant”, which is a summary of the scientific conference held on 24 May 2017 at the seat of the Supreme Court, was also presented during the conference.

The Polish Insurance Association, on its own behalf and on behalf of the Polish Association of Medical Certification (PTOL), would like to invite you to a scientific conference entitled “ICF – A New Look at Humanity”, which will take place in Wrocław on 17 November 2017 at Hotel Radisson (ul. Purkyniego 10).

The International Classification of Functioning, Disability and Health (ICF), adopted by the World Health Assembly (WHO) in 2001, describes the typical characteristics of the state of health of humans in the context of their individual situations in life, and the effect of the surrounding environment. Use of the classification to assess the health condition and its influence on further functioning of people is significant to efficient functioning of the health protection system, social policy as well as social and commercial insurance systems.

In order to popularise the usage of the ICF to assess the condition of claimants in commercial as well as social insurance, the PIU, together with the PTOL, is organising a conference of which the key topic will be the benefits of implementing the ICF. The meeting is addressed, above all, to certifying physicians and court-appointed experts determining the state of health of patients and other groups interested in implementing the ICF. We believe that a discussion on the substantive issues will strengthen interest in using the ICF in Poland.

This event is a continuation of the spectacularly successful international conference of the same name. The previous conference was organised by the PTOL in cooperation with the PIU, WHO and the Social Insurance Institution (ZUS) under the honorary patronage of the Minister of Health and the Minister of Labour and Social Policy, and was held in 2014.

More than 50 officers participated in specialist workshops organised under the patronage of the Criminal Affairs Bureau of the General Police Headquarters by the PIU Committee for Counteracting Insurance Crime. The workshops that took place on 27 October were the next in a series of meetings. The first pilot course took place on 22 June of this year.

The aim of the courses is to disseminate knowledge about insurance crime to the largest number of officers possible and to increase the effectiveness of the measures being undertaken by the police in connection with the rapid changes taking place with regard to crime.

The program broadens theoretical knowledge of insurance as well as the types, forms and legal classification of insurance crimes, and, above all, the principles and possibilities of cooperation with insurance companies and the tactics for combating insurance crimes. Officers directly involved in combating insurance crimes from selected police units are sent to attend the courses.

50 people attended more legal protection insurance workshops which were organised on 10 October in Poznań by the Polish Insurance Association.

The purpose of the event was to promote and spread information about legal protection insurance. The workshops were run by members of the Legal Protection Insurance Team at the Polish Insurance Association and employees of insurance companies. The speakers explained the essence of this type of insurance and what needs of the customer and agent it addresses. The scope of insurance, the process whereby liability is ascertained, and claim adjustment were also discussed. Jakub Nawracała, legal adviser at the Jakub Nawracała Law Firm, gave a presentation during the workshops on the role of a professional attorney-at-law in resolving legal problems.

The main topic of the Congress was the challenges faced by the insurance and banking community due to pro-consumer changes taking place on the bancassurance market. The Congress was organised by the Polish Insurance Association in cooperation with the Polish Bank Association.

The training seminar “Cooperation between the Police, insurance companies and other insurance market institutions to counteract, expose, and combat insurance crime” was held on 21 and 22 September 2017 at the Police Academy in Szczytno. The seminar was organised by the Polish Insurance Association in cooperation with the Department for Combating Economic Crime at the Criminal Affairs Bureau of the General Police Headquarters.

The consistent objective of the seminar is to exchange practical experiences on contemporary forms of insurance crime and to develop the forms and methods of joint activities to be undertaken by insurers and law enforcement authorities to counteract crime of this kind. Thanks to regular meetings it is possible to update observations and solutions.

This year’s seminar was attended by representatives of: the Department of Cyber Security at the Ministry of Digital Affairs, Bank Cyber Security Centre, Office of the Polish Financial Supervision Authority, Insurance Guarantee Fund, Economic Crime Department of the General Public Prosecutor’s Office and the General Police Headquarters, local Police units, the Central Bureau of Investigation and the insurance sector.

The speakers gave presentations on issues associated with cyber security and the impact of innovativeness on the security of insurance companies and on the subject of profiling perpetrators of insurance crimes. A presentation was also given on the most important legislative changes, including those associated with the implementation of the Personal Data Protection Regulation (RODO), protection of whistle-blowers and changes in the Penal Code and Fiscal Code to extend the scope of confiscation of illegally gained assets. The Polish Insurance Association would like to sincerely thank all those involved – the guests, speakers, and participants for coming and taking part in the seminar, and the Police Academy in Szczytno for making it possible to organise the seminar.

The purpose of the event was to promote and spread information about legal protection insurance. The participants had the opportunity to learn how legal protection insurance actually works in practice. Speakers explained the essence of this insurance and what needs of the customer and intermediary it addresses. The scope of the insurance and the process of handling claims was discussed. Paweł Szklarz, a legal adviser at the Korlex Law Firm, appeared during the workshops and explained the role of a professional legal attorney in resolving legal problems.

More than 70 guests attended the seminar organised by the PIU under the name “One year of application of the Act on the handling of complaints by financial market organisations and on the Financial Ombudsman of 5 August 2015 – remarks on the consequences of the regulation and key challenges for insurance companies from the legal standpoint”. The seminar took place on 29 June 2017.
The seminar was addressed, in particular, to managers of insurance companies responsible for the complaint handling process. It was opened by Andrzej Maciążek, Vice-president of the PIU, and Dorota M. Fal, adviser to the Management Board of the PIU. The participants analysed the provisions of the Act as well as the substantive and statistical approach to the requests being received by insurance companies to consider complaints. Rulings associated with the complaints were also studied. Attorney Łukasz Wilma presented a substantive analysis of the consequences of the regulation and key challenges for the insurance companies, after which Wojciech Brewczyński, manager of the Claim Adjustment Strategy Department/Complaints Section at Warta, presented a review of the key statistics regarding complaints and grievances.
The discussion held at the end of the seminar showed that the problem of complaints is very important for the industry and should be monitored. An account of the seminar and presentations given by the speakers can be found below:

On 24 May of this year a scientific conference was held at the Supreme Court called “Recompense for a claimant injured in a motor accident and for persons close to a claimant.” The conference was organised by the Supreme Court in collaboration with the Polish Insurance Association. The conference was primarily addressed to judges but also to the representatives of other legal professions and the insurance community.
The aim of the conference was to exchange views about the issue of recompense for the harm caused in a motor accident and the scope of claims to which persons close to claimants are entitled in such cases. The conference was attended by more than 100 people, including judges, representatives of the National Council of Legal Advisers, the National Council for the Judiciary, the Supreme Bar Council, the Office for Competition and Consumer Protection, the Insurance Guarantee Fund, the Polish Motor Insurers’ Bureau and the insurance industry. The conference comprised two thematic sessions:

  1. Competitiveness of the legal grounds for recompense for the harm caused by death of someone close de lege lata and de lege ferenda.
    2. Recompense for the harm caused by severe disability of a close person de lege lata and de lege ferenda.

The conference was opened by Wiesław Błuś, President of the Supreme Court, who gave the floor to Maciej Zieliński, who discussed the problem of competitiveness of claims for recompense in connection with the death of a close person de lege lata and de lege ferenda. Later, Józef Zych discussed the issue of recompense in the light of doctrine, judicial decisions and insurance practices. Meanwhile, the President of the PIU, Andrzej Maciążek, gave a presentation on the economic aspects associated with the payment of recompense by insurance companies. Among other things he talked about solutions adopted in other EU jurisdictions as regards the value of the recompense and the entitled persons. He stated that the optimal solution would be a legal regulation:

  • guaranteeing predictability of the value of recompense,
  • eliminating the possibility of lodging new claims based on “new” ways of interpreting the law,
  • placing a statutory limitation on the group of claimants by establishing a closed group denoted by the term “closest family member”.

President A. Maciążek pointed out that this solution has been used successfully for many years in jurisdictions such as Belgium, Denmark, Finland, Spain, the Netherlands, Ireland, Norway, Portugal, Slovakia and for example the United Kingdom. During the discussion the participants suggested that courts, when considering cases, do not have appropriate tools to estimate the extent of the harm, which, in turn, indicates that there is a need for the legislature to regulate certain issues concerning recompense.

The meaning of the term “personal rights” was also a subject of discussion. The correctness of treating family ties as a personal right was questioned in some of the statements. In the second part of the conference, the floor was taken by Jakub Pokrzywniak, Ph.D. (Faculty of Law and Administration, Adam Mickiewicz University in Poznań), who gave a presentation on a topic concerning discovery of new personal rights in judicial decisions (in the context of Article 448 of the Civil Code). The subject of the presentation given by Professor Ewa Bagińska was admissibility in the light of the Civil Code of claims for recompense by close persons in connection with serious harm being suffered by a directly injured person in light of the Civil Code. The second session was dominated by a discussion panel and a heated discussion among the speakers with the participants, during which references were made to the issue of expanding liability for compensation with regard to persons close to a claimant, based on the concept of breach of their personal rights. The majority of the representatives of doctrine attending the conference agreed that this would have to be regulated in a legislative act. The majority of the participants also recognised the problems of insurers concerning unpredictability, important from the point of view of risk assessment, as regards the value of the benefits and scope of the claims being lodged.
