On 20 April 2017, the Polish Insurance Association organised a legal protection insurance workshop. The purpose of the event was to promote and disseminate the knowledge of legal protection insurance. Speakers explained the essence of this insurance and what needs of the customer it addresses. The scope of insurance, establishment of liability and claim adjustment were also discussed. A representative of the District Chamber of Legal Counsels, Marek Koenner, PhD, presented the role of a professional proxy in addressing legal disputes.

On 14 December 2016, the Polish Insurance Association conducted a workshop on legal protection insurance in Katowice, at the Faculty of Law and Administration of the University of Silesia.
The purpose of the event was to disseminate the knowledge of legal protection insurance. Lecturers – members of the Legal protection insurance team, Małgorzata Trybuchowicz and Robert Szywalski – explained the essence and scope of this insurance, what a customer needs and how the agent responds to those needs as well as the process of establishing liability, and claim adjustment features. During the workshop, a speech was given by the representative of the Polish Bar Council, Chairman of the Committee for External Image and Legal Protection at the Polish Bar Council, Roman Kusz, Attn. who presented the role of professional legal representatives in the settlement of legal disputes.

On 13 December 2016, the Polish Insurance Association organised a scientific and training conference under the title of “Current principles of financing medical procedures, including rehabilitation, within the public healthcare system. Indications for rehabilitation treatment in the private system”. The conference had been prepared with employees of insurance companies dealing with adjustment of claims due to personal injuries in mind, and constituted a compendium of knowledge for them.

The conference was opened by Dorota M. Fal, adviser to the Management Board of PIU, who discussed how the healthcare system operates in Poland, along with issues relating to public healthcare as well as the scope and principles of access to the benefits financed from public sources. The issue of patient queues to healthcare services was also addressed, with particular focus on orthopaedic and rehabilitation procedures as well as contracts between medical facilities and the National Health Fund (NFZ). In her conclusion, Dorota M. Fal indicated that although health is of the highest value for Poles, the public healthcare system is affected by a deepening financial gap, which actually limits patients’ access to guaranteed benefits.
The types of post-accident rehabilitation was discussed by Professor Anna Wilmowska-Pietruszyńska, MD, PhD, the Chairperson of the Polish Society for Medical Certification, who emphasized the importance of medical, social and professional rehabilitation in the return of the injured to health and daily life. The Professor also discussed the way of financing and functioning of the aforesaid rehabilitation in Poland as well as the sources of its financing. Then she outlined the principles of functioning of rehabilitation in other countries on the example of Germany. It was pointed out that support to victims of accidents, examination of their fitness for work and financial support are extremely valuable. Finally, it was emphasized that rehabilitation of the injured was an investment, which undoubtedly brings better effects if it is started as soon as possible – preferably just after the accident.
The floor was also taken by Professor Krystyna Księżopolska-Orłowska, MD, PhD, the national consultant in the field of medical rehabilitation, who discussed the importance of rehabilitation in reducing the disability rating and raised the issue of rehabilitation standards existing in Poland.  Professor Księżopolska highlighted the significance of rehabilitation specialists establishing a special plan of treatment and rehabilitation for post-accident patients and the importance of access to treatment and rehabilitation in Poland. The issue of standards applied in long-term rehabilitation was also addressed. The key point of the lecture was the firm statement that the worst possible scenario is a loss of self-dependence by the injured. That’s why rehabilitation should be perceived in compensation categories where one function is replaced by others, using the available capacities of the injured. The aim of the above is to optimise the accident victim’s participation in professional and social life.
During the next part of the meeting, the floor was taken by Joanna Bugajska, MD, PhD, Head of the Department of Ergonomics of the Central Institute for Labour Protection – National Research Institute, who discussed the indications for treatment and rehabilitation of accident victims. On the basis of the project being implemented by the Central Institute for Labour Protection (CIOP) in cooperation with the Social Insurance Institution (ZUS), it was presented what proper post-accident rehabilitation should look like. The advantages of rehabilitation and threats relating to its lack were also presented. Persons participating in the pilot programme of early comprehensive rehabilitation were presented as case studies on the basis of own experience. Lecturers also indicated the importance and possibilities of vocational rehabilitation in Poland and the necessity to treat this issue in a comprehensive manner.
The conference culminated with the lecture of Łukasz Wilma, Attorney, who, from the prospect of resolution of the Supreme Court of 19 May 2016 on the costs of treatment and rehabilitation, presented the procedural approach and the potential rationale of covering the costs of private treatment by insurance companies in the light of judicial decisions. Mr Wilma emphasised that a key term was the principle of full compensation of damage, and a determinant of the scope of compensation is a causal link between the event entailing liability and the consequences. What is important, in the lecturer’s opinion, is that the postulate of natural restitution should be a reference point. Attention was drawn also to the burden of proof, which is distributed between both parties.

On 30 November 2016, the Polish Insurance Association in collaboration with Deloitte organised a seminar entitled: “Taxes in the insurance industry”. The seminar was held at the Mercure Hotel in the Centre of Warsaw, at ul. Złota 48-54.
The topics of the seminar concerned, first of all, amendments to tax regulations from the perspective of the insurance sector (including: clauses against avoidance of taxation, changes in the CIT and PIT taxes, fiscal administration reform, and increasing the criminal and fiscal liability), the requirements for implementation of the procedures of compliance with CRS/Euro-FATCA (including: reporting practices in this area, changes in IFT reporting, the obligations to record actions for the purposes of CRS/Euro-FATCA and the obligation to collect supporting documentation. The recent case law and tax practices in the insurance sector (including: VAT tax on services ancillary to insurance services and the proposed liquidation of the exemption from this tax, tax asset law) and changes in the regulatory environment of the insurance activity; new regulations, case law and market practices (including: Directive 2016/97 dated 20 January 2016 regarding insurance distribution, insurance for accounting for a third party, insurance versus transfer of the subject of insurance, investigation and complaint handling procedures) were also discussed. The amendments to the provisions on transaction prices and their documentation as well as the experiences from controls conducted by fiscal authorities were also widely discussed. The seminar was attended by about 150 insurance company professionals, the Ministry of Finance, representatives of trade press and academic centres.

On 25 November of this year, during the International Tourism Fair in Warsaw, the Polish Insurance Association and the Polish Chamber of Tourism organised a seminar titled: European systems of financial security in tourism”.

The seminar was opened by: Paweł Niewiadomski, the President of the Polish Chamber of Tourism and Andrzej Maciążek, Vice-President of the Board of PIU. Then the floor was taken by Alain Verwilghen, the Secretary General of EGFATT (European Guarantee Funds’ Association for Travel and Tourism in Europe), who discussed financial security system principles in the event of tour operator or travel agent insolvency in the individual member states of EGFATT, with a particular focus on guarantee funds.

Next lecturers were: Reinier Kraamwinkel, the representative of SGR (Tourist Guarantee Fund in the Netherlands), Rui Colmonero, the representative of FGVT (Portuguese Guarantee Fund) and Renata Mancewicz, the representative of the Tourist Guarantee Fund at the Insurance Guarantee Fund. The last speech was given by Michel De Blust, the Secretary General of ECTAA (the European Travel Agents’ and Tour Operators’ Association), who presented the EU law requirements for the security system in the event of insolvency, indicating, among others, the elements to be taken into account while selecting a proper economic model.  The event ended with a discussion panel attended by Reinier Kraamwinkel, Michel De Blust, Paweł Niewiadomski and Beata Kalitowska, the Leader of the Travel Insurance Team in PIU. Piotr Manikowski, PhD, a professor at the Poznań University of Economics and Business moderated a discussion.

On 22 November 2016, the Polish Insurance Association, in collaboration with KPMG, organised a seminar entitled: “Year-end closing – the impact of regulatory changes on accounting and reporting of insurance companies”, which took place at the Mercure Hotel in the Centre of Warsaw, at ul. Złota 48-54.
The topics addressed at the seminar concerned, first of all, accounting, financial and actuarial issues – such as the selected Solvency II issues (limit of contract, unbundling), capital requirement of solvency, differences between insurance technical reserves for the needs of solvency and accounting, differences in valuation of balance-sheet items between PSR and Solvency II, the capacity of deferred taxes to absorb losses, the obligation to examine a report on solvency and financial condition of an insurance company.
Selected issues concerning revenue recognition principles according to PSR, tax treatment of assets for the purposes of solvency and the revaluation of deposits as classified as available-for-sale financial assets were also discussed.
The seminar was attended by nearly 200 insurance company professionals, the Polish Financial Supervision Authority, the Ministry of Finance, representatives of trade press and academic centres.

On 27-28 October 2016, the Holiday Inn Hotel in Józefów near Warsaw hosted the 7th Bancassurance Congress. The main topic of the Congress were the challenges faced by the insurance and banking sector due to pro-consumer changes taking place on the bancassurance market. The Congress was organised by the Polish Insurance Association in cooperation with the Polish Bank Association.

The aim of the conference was to present the reflections of scientific circles concerning, in particular, new legal solutions introduced to the new Act on insurance and reinsurance activity.
The representative of science from the academic centres in Cracow, Toruń, Poznań, Katowice and Warsaw were invited to participate in the conference as lecturers. The Polish Insurance Association organised a conference entitled “The strength of insurance mutuality – the social, economic and legal aspects”, which took place on 19 October 2016 in the Mercure Hotel in the Centre of Warsaw, at ul. Złota 48/54.

The conference was in response to the social demand for competitiveness of economy and effectiveness of enterprises. Its aim was to disseminate mutual insurance knowledge by demonstrating the strengths of insurance mutuality in economic and social parameters. Participants became acquainted with both the theoretical and practical aspects of insurance mutuality.

The conference was also an occasion to assess the conditions and possibilities for the operation of mutual insurance companies in Poland in the light of EU regulations, which have been in force since 2016 and other Europeanmember states’ experiences.
