You are invited by the Polish Insurance Association to the seminar entitled “Legal and Political Risks in Reinsurance” organised by the Reinsurance Subcommittee. The event will take place on 16 June 2015 in Radisson Blu Hotel at ul. Grzybowska 24 in Warsaw between 09.00 a.m. and – 04.00 p.m. The seminar is addressed to people in charge of reinsurance, law firm employees, underwriters, and reinsurance brokers.

This year, the seminar will be devoted to legal aspects of reinsurance contracts. In particular, clauses of political sanctions that give rise to numerous interpretation doubts will be discussed in national and international context. Moreover, the seminar will cover issues related to concluding contracts in international trade. The following topics will be discussed: commercial practices and their meaning for contracting parties, preventive clauses securing interest of insurance companies, and issues related to disputes in international trade, including those related to overdue receivables and statutes of limitations. In addition to providing insight in specific issues, the reinsurance seminar has in recent years become an event that attracts representatives of insurance companies, reinsurance brokers, and reinsurers operating on the Polish market. Thus, the agenda includes time for business meetings. On 2 December 2014, the Polish Insurance Association in collaboration with Deloitte organised a seminar related to tax and legal issues entitled: “Taxes in the insurance industry”.

During the seminar, speakers from Deloitte discussed the most important changes in the tax regulations for 2015, including these concerning: taxation of income from investments of the insurance premium, taxation of benefits received in connection with promotions, insufficient capitalisation, controlled foreign company (CFC) and tax avoidance clause. Changes in regulations on transfer pricing and tax risks with regard to personal taxes were also presented in detail. The most interesting court decisions and interpretations, and tax rulings in 2014 were presented in the further part of the seminar. The possibilities of funding the development of the insurance sector company using public fund, including EU funds, were discussed at the end of the seminar.

The seminar was attended by more than 150 employees of insurance companies, representatives of the Ministry of Finance, of the Office of Polish Financial Supervision Authority, as well as academics and representatives of the media.

On 16 December 2014, the Polish Insurance Association in collaboration with KPMG organised an accounting seminar entitled: “The closing of accounting ledgers according to Polish and international accounting standards”.
During the seminar, speakers from KPMG discussed accounting issues of combining the companies,
including these referring to the method of acquisition and settlement within the consolidation and the allocation of the acquisition price. Financial matters on the moment of revenue recognition, write-off of receivables, impairment of unquoted instruments and IFRS 4 Phase 2 and IFRS 9 were also discussed. Actuarial issues concerning the impact of compensations on the insurance companies finances, valuations of liabilities connected with pension damages and FLAOR report were discussed in the further part of the seminar. Tax aspects of the immediate liquidation of damages, as well as the moment of recognition for tax purposes of acquisition costs and income from reinsurance commissions were discussed at the end of the seminar.
The seminar was attended by more than 180 employees of insurance companies, representatives of the Ministry of Finance, of the Office of Polish Financial Supervision Authority, as well as academics and representatives of the media.

On 23 September 2014, the Conference regarding liquidation of material damage from liability insurance (OC) ppm agreements, organized by the Association of Polish Judges ‘Iustitia’, the Insurance Ombudsman, the Polish Insurance Association and the Polish Chamber of Automotive Industry took place. The conference was dedicated to judges and presented a multi-aspect analysis of process of damage liquidation from the perspective of its participants. The purpose of the meeting was the attempt to define the solutions allowing for the amicable settlement of cases, and in case of proceedings before the court – a better understanding of the essence of disputes resolutions by judges.

The conference was opened by the Marshal dr. Józef Zych, introducing the participants into issues of liability of insurance company. While key issues of the insurer’s liability for vehicle damage have been thoroughly explained in judicature, the criteria referring to expedient and justified costs result in the necessity of individual examination of each case.

The panel prepared by the insurers was dedicated, in particular, to practical actions decreasing the number of cases reaching the court and increasing the number of clients satisfied with the course of process of damage liquidation. Representatives of external entities actively cooperating and participating with insurers in liquidation process — Ekspress sp. z o.o. sp.k. and Toyota Marki, were also invited to deliver the presentation. Further, the presentation of independent car industry delivered by the Chairman of Car Parts Dealers and Producers Association and exhibition of spare parts organized by Inter Cars S.A. served to strengthen the practical resolution of problems of material damage liquidation.

As repeatedly underlined in course of the conference — the integrity of the market is essential. In cases against insurers which reach the court, the rates for lease of a courtesy car are up to three times higher than current market rates. The appointment of the court expert results in further costs, the amount of which often exceeds the pursued, summoned amount. It is characteristic that the vast majority of disputes against insurers is initiated by companies offering “free courtesy car” to the injured party. Usually there are no such disputes in cases, where the injured party has a chance to contact the insurance company first and consider the offer on car lease made by the insurer.

On 17 June 2014, an international scientific conference “ICF – A New Look at Humanity” was held in the headquarters of the Polish Social Insurance Fund (ZUS). The conference was organised by the Polish Association of Medical Certification (PTOL). The Polish Insurance Association, in cooperation with the World Health Organisation and ZUS, acted as co-organisers. The Minister of Health and the Minister of Labour and Social Policy were the honorary patrons of the event.

The event was hosted both by Polish and international speakers. Its purpose was to discuss the profits from implementing the ICF classification and sharing the knowledge on this subject. The conference hosted over 250 individuals, including the representatives of the Ministry of Health and the Ministry of Labour and Social Policy, medical examiners, expert witnesses and delegates of other circles interested in introducing the ICF classification.

The conference was open by Professor Anna Wilmowska-Pietruszyńska (PTOL) who stressed out that the implementation of ICF will allow for proper evaluation of the injured parties’ condition and for comparability in the groups of people who have the same symptoms and disabilities, regardless of the illness diagnosis, their place of residence or status. At the same time, she noted that ICF is a tool offering the possibility of classifying the illnesses, injuries or disabilities, and is needed by the injured parties, doctors and public authorities paying for treatment.

Then spoke Jarosław Duda, the Secretary of State at the Ministry of Labour and Social Policy and the Government Plenipotentiary for the Disabled. He expressed his hope that ICF will change the Polish case law and will become part of the Polish judiciary system forever. Igor Radziewicz-Winnicki, Undersecretary of State at the Ministry of Health indicated the core assumptions of the ICF classification being the best way to harmonise the Polish case law and care over the people in need. Zbigniew Derdziuk, the President of ZUS, said that upon establishing a common language of damages description, i.e. through ICF, some integrated activities must be undertaken with regards to rehabilitation and treatment. Jan Grzegorz Prądzyński, the President of the Management Board of PIU, underlined that not having even a minimal standard of evaluating the non-material damages leads to uncertainty both among the damaged parties and the insurance companies. Paulina Miśkiewicz, the director of the WHO Office in Poland, supported all the above opinions, seeing the ICF classification as the source of benefits for many circles.

Then the invited speakers started their lectures. Jerome Bickenbach, member of the Steering Committee of the Research Section of ICF, explained the meaning of the ICF classification. In his opinion, the ICF classification indicates how to stay in good health and how to allow injured persons to regain their health after accidents. Soren Brage, the Chief Medical Consultant at the Research Department of the Norwegian Labour and Social Care Directorate, discussed the issue of implementing ICF into the social insurance systems. He stressed out that the absence of employees is often caused by accidents and illnesses. ICF may offer the solution for this kind of situations. The advantages of applying ICF in medical certification were discussed by Urban Schwegler from the Institute for Research on Paraplegia in Switzerland. As he noted, introducing changes means costs but it pays back in the longer perspective. Witold Dudziński, the President of the Management Board of the Rehasport Clinic, underlined that the quality of human life is determined by many factors, not only by the state of health. Therefore, it is important that the ill individuals are noticed and obtain care not only from their close families but also from the “neighbours”, i.e. from other persons. Then spoke Roman Zdarek, Chairman of the Supervisory Board of the Medical Law Academy in Prague, who described the methods of applying ICF in evaluating non-material damages in the Czech Republic including the guidelines establishing the precise amounts of performances. The abolition of the regulation binding for almost 15 years, containing the precise catalogue of payments for non-material damages, made the Czech Supreme Court prepare new methodology, created together with insurance companies.

Both conference parts were closed with discussion panels, addressing the issues of advantages and challenges related to implementing ICF (moderator: Julita Czyżewska – Director in the PZU S.A. Group) and to using ICF in evaluation of non-material damages (moderator: Dorota M. Fal – Advisor to the Management Board of PIU). Speakers from Poland and from abroad participated in the panels, including Professor Jolanta Kujawa – PTOL, Ewa Jezierewska – Head of the Corporate Loss Adjustment at STU Ergo Hestia S.A., Jakub Pokrzywniak – Partner in Kancelaria Wierciński Kwieciński Baehr, Piotr Winciunas – Vice-Director of the Medical Examination Department at ZUS.

The Polish legislation was discussed, as it does not regulate the basis for establishing the amount of compensation. Therefore, the courts’ support is needed, along with the support of social insurers and of commercial insurance companies together with other institutions. Changes need to be introduced to unify the Polish judiciary and bring order into it. It was noted that in the opinions of courts the insurance companies have funds for paying the compensation, while not much consideration is given to what should be done so that the injured parties could return to work and enjoy their lives. It was also said that there are no limitations in the Polish law for aiming at predictability of court judgements regarding compensations. ICF could serve this purpose. It was also noted that using the classification for evaluating the health condition and its further effect on the individual’s life is significant for the proper functioning of the healthcare system as well as of the social policy system and social and commercial insurance systems. Educational and economic issues of ICF were also addressed.

It was agreed that, undoubtedly, it was necessary to introduce solutions facilitating the work of courts, of insurance companies, insurers, evaluators and of those who offer fast help to the injured parties. This solution could be the international ICF classification.

In this context, the phenomenon of aggregation of claims in the third party liability insurance, the issues related to environmental damage and cyber risk were discussed. Also, new solutions contained in the reassurance contracts were presented, addressing the needs of insurance companies.

The representatives of RIAD explained that the scope of legal protection insurance is similar in all states, and any differences in approaches to this product stem from the differences in regulations on providing legal services, such as possibility of providing legal services by in-house lawyers of the insuring company. It was underlined that the promotion of this type of insurance took several dozens of years, therefore, its slow growth in the initial stadium is quite natural.

On the other hand, the representatives of self-governments of legal professions explained during their speeches, why providing the services by the self-government members is so important. They expressed, among other things, their doubts regarding quality of services provided by phone, and pointed out the vast list of exclusions from the insurance scope.

The Conference was hosted by Andrzej Maciążek, the Vice President of the Management Board of PIU, who stressed out in the summary that PIU commenced cooperation with legal professions associations in order to develop the interest of its representatives in providing services within legal protection insurance.
