More than 100 people participated in the seminar entitled ‘Summary of two years of the SOLVENCY II system and new challenges for reinsurance’, organised by the Reinsurance Subcommittee of the Polish Insurance Association. The seminar took place on 21 June this year.

The event started with a presentation by Dagmara Wieczorek-Bartczak, Director of the Business Consultancy Department, European Actuarial Services at EY, which focused on summarising four years of application of the ‘Guidelines on passive reinsurance and retrocession’, the first regulation published by the Polish Supervision Authority in connection with the implementation of Solvency II. Then, Lydia Pomp-Bojerianova, Client Executive Austria & CEE at Swiss Re Europe S.A., discussed issues related to the assessment of the effectiveness of insurance risk transfer in reinsurance contracts. The first part of the seminar was concluded with a speech by Mariusz Kuśmierczyk, Data Management Consultant at SAS, addressing quality management in specialised systems, which is crucial for determining the correct exposure of companies to individual risks.

The presentations given in the second part were focused on the current challenges resulting from technological advancement, political situations and legislative changes. Philipp Rosenaurer MLaw, MSc at PwC discussed the definitions of fintech, insurtech, regtech and legaltech, as well as the risks and opportunities for the insurance sector arising from these business and regulatory trends. Agnieszka Kukiełka, Reinsurance Broker at AON Benfield, provided comprehensive information on terrorism and the consideration of this risk in reinsurance contracts. The last speech was given by attorney Anna Tarasiuk, Partner at Łyszkiewicz & Tarasiuk law firm, and was devoted to the impact of the GDPR and IDD on reinsurance.

On 19 June 2018, the Polish Insurance Association, in cooperation with the Faculty of Social Insurance of the SGH Warsaw School of Economics, organised a conference entitled ‘Counteracting insurance cybercrime’.

The conference was a response to the need for creating structures enabling insurance companies to jointly counteract cybercrime in the face of cyber threats emerging in the financial market (including the insurance market) and, consequently, legal regulations on the national cybersecurity system which are being developed. Creating an opportunity for representatives of the financial market to have their first discussions on the approach of insurance companies to cybersecurity resulted in some guidelines on what kind of joint activities should be taken by the insurance market to reinforce cooperation in this field, including developing incident reporting mechanisms. Acquiring knowledge about the principles of cooperation with the banking sector and the entire financial market (especially with law enforcement authorities and state institutions responsible for cyberspace security) was also important.

The event was attended by specialists responsible for cybersecurity on an international, national and sectoral economy level, experts in the field of modern technologies used to create and combat cyber threats, as well as representatives of the Cybercrime Unit of the Polish National Police. The conference was specifically intended for employees of insurance companies involved in general cybersecurity (including IT, compliance and risks departments), but also for the scientific community, as well as institutions and companies involved in insurance.

On 6 June 2018, the Polish Insurance Association organised a workshop entitled ‘Interpretation and implementation of the provisions of the Act of 15 December 2017 on insurance distribution”. The meeting was attended by Ewa Krajewska, Deputy Director of the Insurance Licence Department at the Polish Financial Supervision Authority Office, Marcin Orlicki, PhD, Professor at Adam Mickiewicz University, Legal Counsel, Jakub Pokrzywniak PhD, Professor at Adam Mickiewicz University, Legal Counsel and Piotr Czublun, Attorney, Legal Counsel.

The following issues were presented during the workshop:

  • Changes in the register of insurance agents. Update of data in the register after entry into force of the act on insurance distribution
  • research into client needs before concluding an insurance contract. Legal effects of the general clause of compliance of an insurance contract with client requirements and needs for insurance companies
  • information about an insurance product in the form of a standardised document. Required scope of information vs. structure and complexity of an insurance product
  • close links with an agent and capital links which prevent effective supervision of the Polish Supervision Authority
  • nature of remuneration of agents and persons performing agency activities, avoiding conflicts of interest, remunerating insurers and persons handling group insurance contracts
  • activities excluded from the scope of insurance distribution

The workshop was specifically intended for legal counsels and core employees of insurance companies who are engaged in insurance distribution and agent administration.

During the school year 2018/2019, the Polish Chamber of Insurance became one of the sponsors of the ‘Financially oriented life — how to manage personal finances’ programme, organised by the Society for Promotion of Financial Education. The programme is conducted by 27 teachers in 30 secondary schools throughout Poland, during 18 additional courses dedicated to personal finance. Three classes are devoted to insurance for scenarios prepared by PIU (personal accident insurance or PAI, RCA for motor vehicle owners, life insurance), which coincide with the current curriculum base of the Ministry of National Education.

Over 50 employees of insurance companies took part in training on the future legislative changes in the prevention of money laundering and the financing of terrorism. The training was organised by the Polish Insurance Association in cooperation with the law firm Bird & Bird.

The training focused on new legislative obligations in risk assessment that insurance companies need to meet, changes in regulations regarding the identification of beneficial owners and politically exposed persons (PEPs), as well as increased penalties for infringing regulations on money laundering and the financing of terrorism.

During the training, the speakers also referred to several questions concerning the draft regulations, which were prepared by the Group of Experts on Anti-Money Laundering at PIA and sent to Bird & Bird beforehand. The training was interactive and the participants asked many additional questions and explained their understanding of the new legislation.

Nearly 200 people attended scientific conferences which were organised in November and December by the Polish Insurance Association together with the Polish Association of Medical Certification (PTOL). The conferences “ICF – A New Look at Humanity” were held in Wrocław, Lublin, Gdańsk and Warsaw. The Warsaw conference was co-organised by the Ministry of Agriculture and Rural Development. The events were attended by certifying physicians, court-appointed experts, representatives of science, the Social Insurance Institution, Agricultural Social Insurance Fund, and representatives of the insurance industry.

Topics concerning disabilities in the certifying systems in Poland as well as organisation and importance of comprehensive rehabilitation in limiting disabilities were discussed by Professor Anna Wilmowska – Pietruszyńska, M.D. – President of the PTOL. The Professor also pointed out that the opening of comprehensive rehabilitation centres in Poland in the near future will be the culmination of many years of work. Moreover, universities in Warsaw, Lublin and Wrocław will also offer a post-graduate course for future rehamanagers.
Dorota M. Fal – adviser to the Management Board of the Polish Insurance Association, explained what the ICF is and gave a presentation on its structure and application. Replying to a question about whether the ICF language describes the harm suffered by claimants, she presented the possibility of using the ICF to describe bodily injury or health impairment to determine the value of compensation and recompense. Meanwhile, use of the ICF in compensation practice was discussed interchangeably by Michał Kretkowski – President of ICR Sp. z o.o. and Konrad Bednarowski – Project Management Manager ICR Sp. z o.o.

One important conclusion can be drawn from all four conferences: the primary goal is to restore the ability of a person injured in an accident to function in society, and all solutions, including those of the insurers, should be devoted to attaining this goal. A necessary tool, approved by the WHO, which is transparent, clear, and intelligible to everyone, from physicians, through therapists to civil servants and business representatives, is the ICF.

*The International Classification of Functioning, Disability and Health (ICF), adopted by the World Health Assembly (WHO) in 2001, describes the characteristics typical for the state of health of humans in the context of their individual situations in life and the effect of the surrounding environment. Use of the classification to assess the health condition and its influence on further functioning of people is significant to efficient functioning of the health protection system, social policy as well as social and commercial insurance systems.

More than 130 employees of insurance companies, the Ministry of Finance and academic centres participated in a seminar called: “Taxes in the insurance industry – changes in the tax regulations”. The seminar was organised by the Polish Insurance Association in collaboration with PwC.

The seminar primarily addressed the issue of changes in the tax regulations from the perspective of the insurance sector (including changes in income tax, the tax code, and VAT). The current judicial rulings related to taxes, tax inspections and tax practices in the insurance sector, as well as transfer pricing, JPK and the law avoidance clause, were also discussed.

On 4 December 2017 at Hotel Gdańsk (ul. Szafarnia 9) a scientific conference entitled “ICF – A New Look at Humanity”, organised by the Polish Insurance Association and the Polish Association of Medical Certification (PTOL) was held.

The key topic of the conference was the benefits of implementing the ICF. The meeting was addressed, above all, to certifying physicians and court-appointed experts determining the state of health of patients and other groups interested in implementing the ICF.

This event was a continuation of the spectacularly successful international conference of the same name. The previous conference was organised by the PTOL in cooperation with the PIU, WHO and the Social Insurance Institution (ZUS) under the honorary patronage of the Minister of Health and the Minister of Labour and Social Policy, and was held in 2014.

220 employees of insurance companies, the Polish Financial Supervision Authority, the Ministry of Finance, the Central Statistical Office and academic centres participated in a seminar called “Impact of regulatory changes on accounting and reporting of insurance companies”. The seminar was held on 30 November 2017 and was organised by the Polish Insurance Association in collaboration with KPMG.
The topic of the seminar was accounting, financial and actuarial matters – among other things selected issues ensuing from the implementation of Solvency II (solvency capital requirement – SCR – errors and problems with determining it, economic balance sheet – valuation rules and solvency and financial condition reporting – SFCR). Selected issues concerning IFRS 17, the new Act on certified auditors, classification of investments, activation of costs in intangible assets and definitions of group 3 insurance in section I were discussed.
During the seminar, Mrs. Beata Baluta, director of the Insurance Supervision Department of the Polish Financial Supervision Authority, gave a presentation on the most important urgent issues concerning accounting and reporting of insurance companies for the purpose of supervision.
